Khula in Pakistan is a legal right granted to Muslim women allowing them to seek a dissolution of marriage through the court if reconciliation is no longer possible. Unlike talaq, which is initiated by the husband, khula is initiated by the wife on valid grounds such as incompatibility, cruelty, or neglect. The process begins by filing a family suit in the Family Court under the West Pakistan Family Courts Act, where the woman must clearly state her reasons for seeking divorce. After notices are issued and both parties are heard, the court may decree khula if it is satisfied that the marriage cannot continue.
